Cash Discount Compliance
The PYMO Cash Discount program is fully legal and compliant in all 50 U.S. states under federal law.
Durbin Amendment (Dodd-Frank Act, 2010): Federal law permits merchants to offer a discount to customers who pay by cash or check. Cash Discount programs are explicitly allowed and are not surcharges — they are discounts for cash-paying customers.
Our program is structured to comply with all card network rules (Visa, Mastercard, Discover, and American Express) and applicable state regulations. Merchants enrolled in the Cash Discount program are required to display proper signage at the point of sale disclosing the program to customers before a transaction is initiated, as required by card network rules.
Merchant Disclosure Requirements
Merchants participating in the PYMO Cash Discount program must:
- Display signage at the entrance of the business and at the point of sale disclosing that a cash price and a card price apply
- Display the cash price on all menus, shelf tags, or price lists
- Ensure the card price (which includes the service fee) is only displayed at the terminal at time of purchase
- Never refer to the program as a "surcharge" — it must be presented as a cash discount
PYMO provides all required signage materials to enrolled merchants at no cost.
ISO Registration & Processing Infrastructure
PYMO operates through Florida Merchant Services, a registered Independent Sales Organization (ISO) with the major card networks. Our processing infrastructure runs on Tier-1 payment rails, the same infrastructure used by the largest US payment processors.
Merchant accounts are underwritten and maintained in compliance with:
- Visa and Mastercard Operating Regulations
- PCI DSS (Payment Card Industry Data Security Standard)
- Bank Secrecy Act (BSA) and Anti-Money Laundering (AML) requirements
- Applicable Florida state financial services regulations
SMS / A2P Messaging Compliance
PYMO's SMS communications comply with the Telephone Consumer Protection Act (TCPA) and the A2P (Application-to-Person) 10DLC messaging requirements set by U.S. mobile carriers.
Our SMS program:
- Only sends messages to individuals who have provided explicit written or digital consent
- Includes opt-out instructions in every message (reply STOP to unsubscribe)
- Maintains records of consent for all message recipients
- Does not send unsolicited commercial messages
- Honors all opt-out requests within 24 hours

Data Security
PYMO takes the security of merchant and consumer data seriously. We implement industry-standard safeguards including:
- Encrypted transmission of all sensitive data (SSL/TLS)
- Limited access to personal data on a need-to-know basis
- Secure deletion of processing statements not resulting in a merchant agreement
- No storage of full card numbers or sensitive payment credentials on our systems
Prohibited Business Types
PYMO is unable to process payments for certain high-risk or prohibited business categories under card network rules and our ISO agreement. If you are unsure whether your business qualifies, contact us before submitting an application.
